IEPs come protections; however, there are three myths going around about IEP’s. #1 You cannot fail a class if you have an IEP. Not true. You can fail, however, you’ll want to request an IEP meeting to find out why your child is failing and develop a plan to put to ensure that your child is not continue to fail. #2 your child cannot be retained (or held back). Not true. Again, if you’re at this stage, you’ll definitely want to have an IEP meeting and possibly look into some additional testing to find out what’s going on if it’s been a while since an evaluation has been done. #3 Your child cannot be suspended. Not true. Your child can be suspended. However, if they are suspended for more than 10 days of out of school suspension within the school year, the IEP team must hold a manifestation determination review meeting to determine whether or not the behavior was a manifestation of your child’s disability. If it was not a manifestation of your child disability, your child would have to serve that suspension.
