Lead based paint disclosure forms and the pamphlet Protect your family from lead in your home are not required on every home that is for sale or for rent. These disclosures are required on homes that were built prior to 1978. This is a surprise for a lot of people because we commonly hear from customers and clients that they believed these disclosures were required on every home for sale or for rent and that is actually false. • A seller is required to compete the lead based paint disclosure form if their home was built prior to 1978. There are two questions the seller is required to answer under the Seller's Disclosure and they are similar to the questions below: • (a) Presence of lead-based paint and/ or lead based paint hazards • The seller is required to select one of the following two choices • _____ Known lead-based paint and / or lead based paint hazards are present in the housing • or • ______ Seller has no knowledge of lead-based paint and / or lead-based paint hazards in the housing • (b). Records and reports available to the seller • ______ Seller has provided the purchaser with all available records and reports pertaining to lead-based paint and / or lead-based paint hazards in the housing (list documents below). • ______ Seller has no reports or records pertaining to lead-based paint and / or lead-based paint hazards in the housing. • It is important to understand that even when the seller of a home that was built prior to 1978 discloses that they have no knowledge of lead in the home, that doesn't mean there isn't lead based paint somewhere in the home.
