Are you worried about being disinherited? Today we are talking about how to avoid disinheritance. How can I avoid being disinherited by my stepparent when my parent dies? I get asked this question a lot, so here are the things that you need to do to protect your inheritance. • 1. Figure out what it is that you actually want. Is there a family cottage you would like to inherit? Or maybe there's an IRA account that you helped them choose stocks for. If you have some sort of stake or opinion about these things, write them down. • 2. Next, have a conversation with your parents about their estate planning. Ask them about your role in their planning, if they become incapacitated or pass away. If you do not have a role, who is? Who are their powers of attorney? The trustee or personal representative? • 3. Get a copy of those documents, especially if you have a role in the estate plan. If you don't have a role, talk to those people to make sure they have the documents that they need. You want to hold them accountable for your upholding your parent's wishes. • 4. Ask your parents what they think their estate plan does. Ask them if they have updated them recently, in case something has changed. Ask them about their specific wishes for end-of-life care. Would they prefer cremation, a burial, or something else? • Lastly, go to an independent attorney and make sure the documents say and do exactly what your parents think they do. If it has been a long time since they were drafted it is a good idea to look at them. As life goes on things change. A strong estate plan is one that is maintained throughout your life. • Call us at (800) 667-5291 to schedule your FREE strategy session today. • #EstatePlanningAttorneyMichigan #ElderlyCareAttorney #WillsAndTrusts
