United States | 479 F.3d 296 (2007) • A court considered the boundaries of the state secrets doctrine in El Masri versus United States. • Khaled El Masri, a German citizen of Lebanese descent, was traveling in Macedonia when Macedonian officials detained him and handed him to American Central Intelligence Agency operatives. The operatives flew him to an agency facility in Afghanistan and for five months interrogated him and allegedly mistreated him. After establishing that El Masri wasn’t whom his captors were looking for, he was returned to Germany. • El Masri sued former C I A director George Tenant and others, alleging that his abduction and detention, pursuant to a federal policy called extraordinary rendition, violated his rights under American and international law. • The United States intervened, claimed the state secrets privilege, and moved to dismiss El Masri’s claim. The then current C I A director submitted two sworn declarations. The first explained the government’s reasons for asserting the privilege. The second, sealed and classified, provided evidentiary support for the government’s position. • El Masri responded that the media had discussed the rendition policy and government officials had acknowledged its existence. So, it wasn’t a state secret. Nevertheless, the district court dismissed the case, and El Masri appealed to the Fourth Circuit. • Want more details on this case?
