Commissioner | 64 T.C. 245 (1975) • Many tax disputes aren’t a question of whether the taxpayer received income but when that income was received. The I R S has several tools to determine timing, including the constructive-receipt and economic-benefit doctrines. In Pulsifer versus Commissioner, the United States Tax Court applied these doctrines to determine when to saddle a taxpayer with additional taxes. • In nineteen sixty-nine, Gordon Pulsifer purchased a ticket in the Irish Hospital Sweepstakes on behalf of himself and his three minor children. The ticket was represented by a horse named Saratoga Skiddy, who was running in the Lincolnshire Handicap. Saratoga Skiddy placed second, winning the Pulsifers forty-eight thousand dollars. • However, because the three children were minors, Irish law required their share of the winnings to be deposited with the Bank of Ireland. The money wouldn’t be released until the children turned twenty-one years old or until an application to the Irish court was made on the children’s behalf by their legal representative. • The Pulsifer children didn’t report their winnings as income in nineteen sixty-nine. On review, the commissioner of internal revenue determined that the children’s winnings should’ve been reported as income in nineteen sixty-nine and assessed a deficiency. • The children asserted that their winnings shouldn’t be taxed until released by the Irish court and petitioned the United States Tax Court for a redetermination. • Want more details on this case?
