Taylor Swift fought a five year legal battle over plagiarism allegations on her 1989 hit song “Shake It Off.” Songwriters Sean Hall and Nathan Butler argued Taylor Swift's chorus in “Shake It Off”, specifically the lyrics Cause the players gonna play, play, play, play, play, and the haters gonna hate, hate, hate, hate, hate, infringed on the copyright for their 2001 song Playas Gon' Play performed by 3LW. Fitzgerald initially ruled in favor of Taylor Swift, stating the lyrics players gonna play and haters gonna hate were too brief, unoriginal, and uncreative to warrant copyright protection. Judge Fitzgerald cited similar lyrics in ‘Dreams’ by Fleetwood Mac and ‘Playa Hater’ by Notorious B.I.G. • The Judge Fitzgerald ruling was overturned by the Ninth Circuit Court of Appeals in 2019 which found “enough objective similarities” that copyright infringement should be “decided by jurors not judges.” Years of legal back-and-forth ensued before a trial date was set for January 17, 2023.
