2023 November Visa Bulletin and EB5 Policy Change of Sustainment Period to 2 Years

The November visa bulletin update has been released revealing the final action dates and priority dates eligible to adjust status for EB category visa's including EB-5 Visa. The USCIS policy and guidance for how they would treat the Sustainment Period, or minimum investment period for which the EB-5 investment must be maintained at risk has been clarified as two years from the time of investment. That is a significant departure from the original guidance which was maintaining investment from the beginning of the conditional residence period which could not start until after I-526 approval, adjustment of status or consular processing and finally entering the U.S. utilizing the EB-5 visa.
