Simple Evidence Strategies to Win Your EEOC

Evidence is THE thing in an employment discrimination case. It's how I won my EEOC claim against NASA. It was a challenge, organizing all that documentation so that I could find everything when I needed it. Here's the strategy I used to document my case manage my evidence so that I could easily find things when I needed them. • From timelines to file structures, here's how I did it. • EEOC on Evidence: • https://www.eeoc.gov/laws/guidance/cm... • Some Documents You May Need: • Emails and other documents relevant to the specifics of your claim • Witness Statements (see my video on how to get them) • Policies and Procedures that cover how your employer handles EEOC claims • Policies and Procedures that cover how your employer manages time keeping • Copies of your performance appraisals for at least 2 years • Copies of your leave records for the past year • Employment Contracts Codes of Conduct • -Collective bargaining Agreements • -Copies of any forms or other requests related to your claim (EVERY version you submit) • Emails you sent along with the forms or requests • -Doctors' letter (to support disability claims) • Doctors /or therapists' letter (to support claims of emotional pain suffering) • Detailed notes from ALL meetings about your case (dates, times, full names of participants) • -Notes/Emails to Yourself to document anything that happens outside meetings • Employee Survey Results that support your case • At the evidence-gathering stage, it's essential to understand PRETEXT - how your employer will try to use it how you can defeat it.
