An employee who is covered by the Act is termed “non-exempt” because the employee has not been exempted from the requirements of the law. Non-exempt employees generally are paid hourly and must receive the federal minimum wage or more and must be paid time and a half for any overtime worked in excess of 40 hours in a week.
