Novick Transfer Co. | 17 F.R.D. 279 (1955) • The Federal Rules of Civil Procedure require notice pleading, which means that a plaintiff’s complaint only has to include enough information so that the defendant has notice of the issues the plaintiff intends to raise. This pleading standard is flexible and doesn’t require a plaintiff to allege a lot of specific facts. In Bell versus Novick Transfer Company, the Maryland federal district court had to decide whether a plaintiff’s complaint was sufficient to satisfy the rules. • After a truck collided with their car, Raymond and Levada Bell, and their son Ronald, sued Novick Transfer Company, the truck’s owner, and Morris Jarrett Coburn, the truck’s driver. The Bells’ complaint described the accident, its date and location, and alleged that because Coburn operated the truck negligently, Ronald was injured. The Bells also alleged injuries and damage as a direct result of Novick’s and Coburn’s negligence. • Novick removed the case to the Maryland federal district court and filed a motion to dismiss the complaint.
