Bail is a fundamental aspect of criminal justice, rooted in the principle of liberty. Despite the Supreme Court's stance that bail is the rule, jail is the exception, India's prisons are overcrowded with undertrial prisoners. Over 2/3 of inmates are undertrials, with most charged for offenses punishable by seven years or less. The Law Commission noted that 60% of arrests are unnecessary, accounting for 40% of prison expenditure. • Currently, 220,810 bail applications are pending in trial courts, with 21% over a year old. High Courts face 113,816 pending bail matters, 36% older than a year. The backlog is straining the judiciary and infringing on personal liberty. Most undertrials come from marginalized groups and are accused of minor crimes.
