Scothorn | 77 N.W. 365 (1898) • The body of caselaw that forms the basis of today’s legal landscape comes primarily from two sources: law and equity. Courts of law created rigid, precise legal rules. For example, law courts gave us the essential elements of a contract: an offer, acceptance, and consideration. If any of these elements is missing, there’s no enforceable contract. From time to time, that rigid rule resulted in some pretty harsh decisions. So courts of equity created a body of equitable principles that gave hope to parties unable to recover damages in law courts. One equitable principle, associated with agreements or promises that don’t rise to the level of enforceable contracts, is the notion of equitable estoppel, sometimes called detrimental reliance. In Ricketts versus Scothorn, the Nebraska Supreme Court applied the doctrine of equitable estoppel to protect a party who had changed her whole life around in reliance on a promise. • Katie Scothorn worked as a bookkeeper. But her grandfather, John Ricketts, didn’t want her, or any of his grandchildren, to have to work. He gave her a promissory note, intending that the note, and the interest payments due on it, would leave her free to quit her job. And when he gave her the note, she did quit her job. • Ricketts made the interest payments on the note for a year, but then found himself unable to continue the payments. He expressed his intent to pay off the note as soon as he sold his Ohio farm. But two years later, having made no further payments to Katie, Ricketts died. Katie then sued the executor of her grandfather’s estate for the outstanding balance due on the note. • The trial court ruled in Katie’s favor, and the executor appealed to the Nebraska Supreme Court. • Want more details on this case?
