Schedule a case evaluation here: • https://www.jasontees.com/services/ • In today's update, I discuss how ridiculous the SBA is being when it comes to the liquidation of business assets. • The client forwarded me an email they got from the SBA stating that if they're going to liquidate the assets, the SBA wants to know what personal assets the borrower can put up to replace the assets that are being sold. • Record scratch.....whaaaaaat? • Considering that the SBA is not going to handle any of these liquidations themselves, and they need borrowers to handle the liquidation, I find it to be preposterous that they would have the nerve to ask people to replace the collateral being sold with personal assets. • If you think about it, it would essentially be better for borrowers not to be helpful as far as liquidation goes, because in that case no one's going to ask them to pledge personal assets as collateral for the loan. • It seems like classic government thinking. One person making a arbitrary decision off the top of their head without giving any consideration to the real life consequences. • If, as a borrower, my options are to not help with the liquidation, and therefore not be asked to pledge personal assets OR to spend the time and effort to find a buyer for the assets only to be asked to pledge additional assets, the decision is an easy one. I would sit tight till the espada to come get the stuff otherwise it's going to go in the garbage. • Especially considering offering compromise is not even an option, there's no reason to generate any goodwill with the SBA since they're not going to be willing to negotiate any sort of forgiveness anyway. • Bottom line: the SBA is going to punish people who want to do the right thing and sell the assets.
