The other type of non-competitive practice that you have to watch out for is that if you have a contractor that helps you develop the specifications, they can’t also do the work. So, let’s say the air conditioning unit on this building goes out, and we have to hire somebody because I don’t know anything about air conditioning, other than there’s something called SEERS, we’re going to hire a contractor to help me write evaluation criteria so I can actually go out for bid to find someone to fix it. I can’t, then, hire that same contractor to do the work. This is a specification, they’ve helped design it, it would be too easy for them to narrowly guide the specifications so that they are the only ones in the whole place who can actually do the work. So, that’s why there’s this prohibition. You can’t have a contractor write the specs and do the specs. If you have a contractor write the specifications for a bridge, they couldn’t also build the bridge. So, what is common is you’ll have an engineering firm, or something like that, who will help you develop the specifications, and then you put it out for bid and you would hire them differently. Now, sometimes people will ask me, “But wait a minute, what if we have a little bit of work and we want to know a rough estimate, and I call them up, how much should I put in the budget, is that really, you know, something I have to not do?’ and I would say, just tread lightly, be a little careful, if it’s more kind of informal, hey, I’m just trying to get a range, and they give you a range, and that’s what you put in the budget, that’s not quite the same thing as them saying, “These are the criteria that you’ll use in the proposal.” So, watch out for that one, this one also gets a lot of scrutiny.
