Free Speech Coalition | 535 U.S. 234 (2002) • Technology now lets us see things that’ve never actually existed. Virtual technology can also be used to create sexually explicit images of imaginary persons or actions. But once virtual technology was used to create images of imaginary minors, Congress reacted. That reaction set the stage for the 2002 case of Ashcroft versus Free Speech Coalition. • Since 1976, federal law has prohibited the production, distribution, or possession of sexually explicit images of children. Then, in 1996, Congress passed the Child Pornography Prevention Act, or CPPA, which expanded the definition of banned child pornography to include sexually explicit images of children, even if the images didn’t depict any actual child. The Free Speech Coalition, an adult-entertainment trade association, filed an action against Attorney General John Ashcroft and the United States to challenge the CPPA’s expanded definition of child pornography. The federal district court ruled in the government’s favor, but the circuit court of appeals reversed, holding the CPPA unconstitutional. Because other circuit courts had upheld the CPPA’s constitutionality, the United States Supreme Court granted cert to resolve the circuit split. • Want more details on this case?
