Supp. 2d 648 (2011) • Parents, like all people, are susceptible to mistakes in judgment. But if a parent’s mistake results in harm to his or her child, can the child sue the parent for damages? Historically, the answer was no. Most American jurisdictions have followed the parental-immunity doctrine, which bars a minor child from bringing a tort action against his or her parent. But in Neel versus Sewell, we explore an example of modern refinements to the parental-immunity doctrine. • When seventeen-year-old Brandon Neel, his father David Evans, and his aunt Tina McLean helped his step-grandmother Beverly Sewell clean out her house, they started a fire in the backyard to dispose of garbage. While Neel and McLean were tending the fire, a bag containing an aerosol can exploded, causing Neel to incur severe burns to his face and arms. • Neel filed suit against Evans and Sewell, seeking damages for his physical and emotional harm. Regarding Evans, Neel alleged that Evans was negligent in his supervision of Neel because Evans failed to ensure the use of safe practices in the disposal of flammable materials and failed to instruct Neel on such safe practices. • Evans filed a motion for summary judgment in the United States District Court for the Eastern District of Michigan, arguing that under Michigan law, a parent couldn’t be liable to a child for negligent supervision. • Want more details on this case?
