In Miller versus Fenton, we explore what renders a confession involuntary. • Detective Charles Boyce interviewed thirty-two-year-old Frank Miller regarding a murder. Throughout the interview, Boyce maintained a friendly, sympathetic demeanor. He gave Miranda warnings, informing Miller of his constitutional rights and that any statements could be used against him. Boyce then asked questions about Miller’s movements. Miller, who possessed average intelligence and had a criminal history, gave evasive responses. Miller also showed little reaction when Boyce falsely announced that the victim had just died from her injuries. • Boyce then tried a different interrogation tactic, offering himself as a friend to whom Miller could unburden his troubles. Boyce repeatedly stated that Miller wasn’t a criminal needing punishment, but someone with a psychological problem needing treatment, and that Boyce wanted to help with that problem. Miller initially remained guarded. But less than an hour into the interrogation, Miller confessed then collapsed from shock. • Before his murder trial, Miller moved to suppress the confession, arguing that Boyce’s psychological coercion rendered it involuntary. But the state trial court admitted the confession, and Miller was ultimately convicted.
