Vans Skate Park, 901 A.2d 381 (2006) • Parents make numerous decisions, big and small, for their children every day. But parents don’t have the authority to make certain decisions that impact their children’s legal rights, as Hojnowski versus Vans Skate Park illustrates. • Anastasia Hojnowski took her 12-year-old son Andrew Hojnowski to a commercial skate park owned and operated by Vans, Incorporated. Before Andrew entered the park, Anastasia signed a contract containing a liability release and arbitration agreement. The liability release waived Andrew’s right to seek damages for future injury caused by Vans’s negligence. The arbitration agreement committed Andrew to resolve any disputes with Vans in arbitration rather than court. • Once inside the park, Andrew broke his leg because another skater aggressively forced him off a ramp. Andrew sued Vans for negligence in a New Jersey court, seeking to void the liability release and arbitration agreement. Vans moved for summary judgment. • The court granted Vans’s motion, dismissed the complaint, and ordered arbitration, leaving the validity of the liability release to the arbitrator. The appellate division affirmed in part and reversed in part, holding that the arbitration agreement was enforceable but that the liability release violated public policy.
