America’s criminal legal system is unduly harsh. The United States has less than 5 percent of the world’s population, yet nearly 25 percent of its prisoners. • The resulting mass incarceration doesn’t make us safer. And our reliance on a system of punitive excess has crushing racial, economic, and social consequences that reach far beyond a person’s prison sentence. A felony conviction can result in barriers to housing access, employment opportunities, and even voting rights. • At every step — from policing to prosecution to incarceration to life after prison — our nation has prioritized excess punishment over more supportive ways of dealing with social harm. Across the board, poor communities and people of color are disproportionately criminalized and punished. • What can we learn from the failures of mass incarceration and how can we rethink our approach to criminal justice so that we prioritize human dignity over human misery? • In the Brennan Center’s Punitive Excess series, people impacted by mass incarceration and a group of experts explain how we got here and outline solutions that would benefit everyone.
