Civil Procedure Rules - Chapter 12: Summary Judgment under Order 14 (CLP) • In the normal course of a civil suit, the Plaintiff’s action will go to trial and this incurs time and costs. Instead of going to trial, the Plaintiff can apply for summary judgment if the following conditions are met:- • (a) Defendant must have entered an appearance; • (b) the statement of claim must have been served on the Defendant; and • (c) the affidavit must comply with the requirements of O.14 r.2 of the Rules of Court 2012. • If the Court is of the opinion that the Defendant has no triable issues in his defence, then the summary judgment will be granted. • #clp #law #SummaryJudgment #O14 #civil • Like our: • FB Page - / student-counsel-102849881092003 • Youtube - / @studentcounsel2246
