Williams | 504 U.S. 36 (1992) • A grand jury hears evidence presented by a prosecutor and decides whether to issue a criminal indictment. The grand jury hears only the prosecution’s side of the case, which might explain the old saying that a grand jury will indict a ham sandwich. In United States versus Williams, the defendant argued that the grand jury wouldn’t’ve indicted him if it’d heard some evidence the prosecutor withheld. But could the district court do anything about it? • A federal grand jury indicted John Williams for bank fraud. After reviewing the exculpatory portions of the grand jury transcripts, Williams moved to dismiss the indictment on the grounds that the prosecution had failed to present certain exculpatory evidence that would’ve directly negated the offense’s intent element. Following a hearing, the district court ruled for Williams, dismissing the indictment without prejudice to the government’s ability to refile. The district court concluded that the evidence raised reasonable doubt about Williams’s guilt and therefore called into question the grand jury’s decision to indict. The Tenth Circuit affirmed, relying on its previous decision in United States versus Page, in which it held that the government had an obligation to present substantial exculpatory evidence to a grand jury.
