Medley | 570 N.E.2d 27 (1991) • When Dan Cullison invited Sandy Medley for a soda, he didn’t expect a confrontation with her angry family. Although physically unharmed, Cullison still sued the Medleys for a medley of intentional torts. Here’s what happened in the case of Cullison versus Medley. • During a chance encounter, Dan Cullison invited Sandy Medley to have a soda with him and visit him at home. That night, someone knocked on Cullison’s door. When he answered, someone he couldn’t see in the dark said she needed to talk to him. Cullison excused himself to don pants. Returning, he found Sandy; her father, Ernest; her mother, Doris; and two others in his living room. Ernest sported a revolver in a thigh holster. Ernest never took the gun out of its holster, but he grabbed at it and shook it at Cullison while threatening to jump on him. None of the Medleys touched Cullison, but he feared being shot. When the Medleys left, Cullison experienced chest pains and feared he was suffering a heart attack. He also experienced severe emotional and psychological harm. • Cullison sued the Medleys for trespass, assault, and intentional infliction of emotional distress. The trial court granted summary judgment for the Medleys, and the court of appeals affirmed.
