Attorney William C. Mason sits down to discuss: • A DURABLE POWER OF ATTORNEY is a document that gives somebody you designate the ability to make legal and financial decisions on your behalf. This person you select, your Agent is commonly referred to as your Attorney-In-Fact. Your Attorney In Fact is responsible for managing your legal and financial affairs and has a duty to act in your best interest. A Durable Power of Attorney comes in 2 forms, General and Limited. A General Power of Attorney gives you Attorney-in-Fact broad Authority to act on your behalf with respect to your financial and legal affairs. While on the other hand a limited Power of Attorney gives the Attorney-In-Fact specific and numerated powers to act in your behalf to act with respect to specifically identified matters. A Power of Attorney is typically drafted in one of two ways in regards to “effect”: • Springing: Your Attorney-in-Fact cannot act on your behalf until you are either declared legally incapacitated by 2 doctors or by court order. • Immediate: Your Attorney-in-Fact can begin acting on your behalf the moment the document is signed. • An ADVANCE HEALTH CARE DIRECTIVE also known as a Durable Power for Healthcare or a medical directive gives somebody you designate the ability to make healthcare decisions on your behalf.
