Please Subscribe! • Corruption- debasement of integrity positions privilege or other self benefit. A key component of corruption is called quid pro quo. • quid pro quo- Latin expression, means something for something. Way to understand corruption is that I am using my official position and organization in order to receive some sort of private game in exchange for an official organizational favor. • Facilitating payments- I’m going to pay you a little extra to do the job that you’d normally do in a faster, better or preferential way. • Subtle Bribery- You’re looking at a change in behavior. Something that they wouldn’t ordinarily do. • Open Bribery- it’s understood that you have to bribe, it’s posted and it’s done actually relatively transparent way. • Major Extortion Bribe- We have gone from the level of you are actively trying to make me change in my behavior by giving me payment to me using threats and an open manner to get you to pay me. So there’s kind of a fear aspect of it. The Bribe is using some kind of power over the Briber. Where an ordinary Bribery opening Celle bribery, the Briber is in the position of power over the Bribe. Bribe initiated is an extortion of Bribe. Briber initiated would be subtle or open bribery. • -It was the Mafia trying to shake down on someone on the other side of the world like California for a Bribe. He said I am not interested in that and he sold out the hotel operations to whatever local competitor he was told to sell to. • -Bribery, at least from an American prospective is illegal, now via the Foreign Corrupt Practices Act or FCPA. • FCPA- makes it a civil and criminal offence to bribe an official of a foreign government or ministry or a member of a foreign political party or Candidate for office. It’s a powerful law with a global reach. Some of you may be thinking well if corruption is so widespread, one of the things that I can do as a manager to prevent bribery/corruption. First of all, set up an ethics and compliance program. Let your subordinates know right away that in a general sense, bribery and corrupt practices are wrong and provide discreet guidelines of what is and is not an act of bribery. • -Example: I remembered someone told me in my previous job that is OKAY to give someone a gift as long it was $50 or less, and it was less than 3 times a year. That company said that did not constitute Bribery, that was a gift. Some company also have the rule that you can receive gifts from people(companies not governments), as long there’s no quid pro quo tied to it, and all other competitors and stakeholders have the opportunity to provide you the same gift. So, there’s preferential treatment. It was a specific guideline provided by that firm. Make sure your policies are in place, you have an advertised anti-corruption program, and you might even want to have a hotline for reporting acts/suspected acts of corruption. Make sure your employees are well trained in your ethics and compliance program, make sure you enforce any penalties against violators. Let people know there are uniformed penalties for those who engaged in acts of corruption. • -When you hire contractors, consultants, agency, intermediary, etc., need to all be on the same page and know what is/not acceptable behavior when it comes to corruption. Because if you don’t and go to a foreign country, you hire a local contractor who engage in corrupt practices, when the media finds out about that, they will blame YOU, the company who hired those contractors not the contractor who engage in corruption practices. Work with your international organizations and its sort of an industry group, pique your trade association and share information/experiences about corruption.
