The Importance of Cooperation with Your Doctor

Social Security disability judges expect you to cooperate with your doctor and comply with treatment options to the best of your ability. If you do not at least try to do what your doctor suggests, the judge may question your credibility and believability and therefore give less weight to your testimony about pain, limitation of movement, medication side effects and other problems. • Most unfavorable decision contain a statement which says something like this while I find that the claimant's medical condition can be expected to result in many of the symptoms alleged by the claimant, I find that the claimant's assertions about the level and intensity of these symptoms is not entirely credible. In such a case, the judge is basically saying that he believes you have some problems but he does not believe your testimony about the severity of these problems. • This lack of credibility statement is not reviewable on appeal as it represents the judge's opinion about your truthfulness. • As I discuss in this video, one of the main reasons why a judge might find you not entirely credible will arise from failure to cooperate with your doctor's treatment suggestions. • Sometimes, you may have no choice when it comes to compliance. For example, you may not be able to afford certain tests or certain treatment. You may fear addiction to pain medications or complain of stomach upset. Whatever the reason, you need to be prepared to explain why you have not fulfilled your doctor's treatment plan.
