Baird | 405 U.S. 438 (1972) • Some of the biggest changes in the law occur when a courageous person challenges the status quo. William Baird was one of those people and, in Eisenstadt versus Baird, he left an enduring mark on the law of reproductive rights. • Baird was a reproductive-rights activist in the 1960s, when many states severely limited abortion and contraception. By the late 1960s, Baird had been arrested in multiple states for speaking out about abortion and birth control. • In 1967, Baird set his sights on Massachusetts, where a statute made it a felony to distribute contraceptives to unmarried people to prevent conception. Distribution to prevent disease was legal, but the statute was clearly hostile to birth control. • However, the statute was on uncertain footing. In the 1965 case of Griswold versus Connecticut, the U.S. Supreme Court held that married couples had a constitutional right to use contraception. Baird sought to challenge Massachusetts’s continuing restrictions on unmarried people. • In April 1967, Baird gave a lecture on birth control at Boston University. When the lecture ended, he gave a woman some contraceptive foam. As Baird had planned, he was immediately arrested. • Baird was convicted in state court and sent to jail. He filed for habeas corpus in the federal courts, arguing that the Massachusetts statute was unconstitutional. The federal trial court denied relief, but the First Circuit Court of Appeals held for Baird and reversed. The state asked the U.S. Supreme Court to review the case. • Want more details on this case?
