Turnipseed | 784 So.2d 239 (2000) • In the United States, people value personal freedom and property ownership, a value that’s reflected in the law. Generally, people have the right to protect themselves and their property. But that right isn’t absolute. Woodard versus Turnipseed examines the limits of self-defense and defense of property. • John Turnipseed fired seventeen-year-old Kenwyon Woodard, a milker on Turnipseed’s dairy farm. Woodard then threatened to get back at Turnipseed. In response, Turnipseed ordered Woodard off the property. But Woodard couldn’t find a ride home. So he waited outside the barn for a friend to finish working. Later, noticing Woodard hadn’t left, Turnipseed repeated his demand. Woodard, who was four feet nine and weighed ninety-five pounds, wouldn’t leave or respond, so Turnipseed grabbed a broom, walked several steps to where Woodard sat, and repeatedly hit him with the broom, causing serious injuries that sent him to the hospital. • Woodard sued Turnipseed for assault and battery. Turnipseed claimed he was rightfully defending himself and his property.
