In our last episode, we talked about Article 37 of the Civil Code. We learned that juridical capacity is the fitness or the ability of a person to be the subject of legal relations. It is extinguished only through death. We also learned that capacity to act refers to the ability of persons to execute actions with legal effects. • Tonight, we’re going to talk about Article 38 of the Civil Code. We’re going to learn about some of the ways our capacity to act can be restricted or limited. We’ll also learn about actions that can be given legal effects, even for a person whose capacity to act is restricted or limited. • By the end of this lesson, you should be able to: • 1. Distinguish full capacity to act from restricted or limited capacity to act; • 2. Enumerate and identify examples of ways by which our capacity to act can be limited; • 3. Cite real-world examples of persons with restricted or limited capacity and the reasons for the limitations. • ************************************** • SHOW NOTES: • 1.
