Calling a Time Out from Debt Problems

Hi, I'm Jonathan Ginsberg. Do you need to call a “time out?” • Now you may find this hard to believe but currently, even at my advanced age, I play rec league basketball. I have played for years and I love the competition and the camaraderie. • If you or your kids have ever played sports you know that a good coach will call a timeout to stop the other team’s momentum. Sometimes that 60 second break in the action can give your coaches and players needed time to figure out what is going wrong and how to fix it. • If you are facing debt problems, your life may be a lot like a basketball game where the opposing team has all the momentum. Fortunately, like in basketball, the rules give you the option to call “time out” if you know how the game works. • Here are a couple of examples of what I mean. • Let’s say that you owe $20k to four or five credit card companies and you are behind. The law allows reps from the credit card companies or collection agencies to call you repeatedly during the day to demand payment. This could mean you are dealing with 20 or 30 calls every day, all day. • The Fair Debt Collection Practices Act gives you the power to call time out. Under the FDCPA, you can write a letter to any collection agency to make them stop calling you. Wouldn’t you agree that you’ll have a lot easier time learning about your options when the phone is not ringing? • If you get sued, you automatically have 30 days to file an answer and if you file an answer any court date on the lawsuit will be delayed several months. But most people take no action when they are sued, figuring that there is no point. Wrong. That 3 or 4 months can allow you time to save up money, or to consult with a lawyer. • Bankruptcy, of course, is the ultimate time out. The minute we file, the automatic stay set out in bankruptcy law puts an immediate halt to all creditor action.
